Marianito is a small, private app for capturing shared aperitif moments with the people you're actually with. These terms are the agreement between you and us about using it. Like our privacy policy, this is written to be read, not to be survived.
The short version: be decent to the people you share a table with. Post things you have the right to post. There is no tolerance here for objectionable content or abusive behaviour — post it and you lose your account. You own what you make; you can leave and take it with you at any time.
Marianito is operated by Niche Studio LLC, a Wyoming limited liability company doing business as Megamind Labs ("we", "us", "our"). Contact: hello@megamindlabs.ai.
The app is distributed on the App Store through the individual Apple Developer account of Cameron Gordon, so that is the seller name Apple shows. Your agreement for the service is with Niche Studio LLC.
Agreeing to these terms
By tapping "Send me a code" on the sign-up screen, you agree to these terms and to our Privacy Policy. If you do not agree to them, don't request a code and don't use the app.
If you use Marianito on an Apple device, Apple's own Licensed Application End User Licence Agreement also applies. Where it conflicts with these terms, these terms apply, except where §14 says otherwise.
Who can use Marianito
You must be 18 or older, or the legal drinking age where you live if that is higher. Marianito is built around aperitif culture and is intended for adults.
You need one account, in your own name, and you're responsible for what happens under it. Sign-in is by a one-time code emailed to you — there is no password — so keep access to that mailbox secure. Tell us at hello@megamindlabs.ai if you think someone else is using your account.
You may not use Marianito if we have previously removed your account, or if the law where you are prohibits it.
What Marianito is
Marianito lets you record a moment shared with people who are physically with you: a photo, a caption, an optional place, and the people at the table. Those people can add their own comments and photos to it. Everyone at a table co-authors that moment.
Two consequences worth being clear about:
A moment is shared, not solely yours. Anyone you tag can see it, and can add to it. Deleting a moment from your own journal hides it for you; the people who were there keep their copy. If you started the moment, deleting your account removes it for everyone at that table.
You can add "guests" — names you type for people who don't have the app. Only you can see the guests you create. Don't use a real person's name in a way that would embarrass or expose them; it's still content about a real person, and §4 applies to it.
Marianito is currently in beta. Things will break, features will change, and data may occasionally be reset while we build. Please don't treat it as the only copy of a photo you care about.
Content and behaviour — zero tolerance
We have no tolerance for objectionable content or abusive behaviour. An account that posts it is removed, and this is not a warning system: for anything serious the first offence is the last one.
You must not post, upload, tag, name, or send:
Sexually explicit material, or anything sexualising a minor. Content sexually exploiting a child is reported to the authorities as well as removed.
Harassment, bullying, threats, stalking, or targeting a person.
Hate speech, or content attacking a person or group over race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity, or sexual orientation.
Violence, gore, or content glorifying self-harm, suicide, or eating disorders.
Content that is illegal where you are, or that promotes illegal activity, including selling drugs or supplying alcohol to a minor.
Impersonation of another person, or a display name, username, guest name, or place name chosen to abuse, deceive, or offend.
Spam, scams, phishing, advertising, or bulk unsolicited content.
Someone else's private information — their address, phone number, or anything else they'd not want posted.
Anything you don't have the right to post, including other people's photographs and copyrighted work.
You must also not:
Photograph or tag someone who has told you not to.
Try to reach data that isn't yours, probe the service for weaknesses, or work around the limits described here.
Scrape, bulk-download, or automate access to the app.
Use Marianito to build a competing service, or resell access to it.
Photograph the people you're with, not strangers. Marianito is for a table you're actually sitting at. Everyone in a photo should know it's being taken.
How we enforce this
Filtering. Text you post — captions, place names, comments, display names, and guest names — is checked against a maintained list of prohibited terms before it is stored. Content that matches is refused: it is not posted, and it is not stored. We maintain and update that list; we don't publish it, because a published list is a guide to getting round it.
The filter checks text. It does not automatically screen photographs. That makes reporting the main control for images, which is why §6 matters.
Reporting and removal. Any user can report any moment, comment, person, or photo from inside the app. We review reports and act on them within 24 hours. Acting can mean removing the content, removing the account, or both.
Blocking. You can block any user at any time from the people list or from a moment. A blocked person disappears from your lists and searches.
Removal. We may remove content or suspend or delete an account that breaks these terms, without notice where the breach is serious. We may also remove content we're legally required to. If we get it wrong, email hello@megamindlabs.ai and a person will look at it again.
We are not obliged to monitor everything posted, and we don't. That doesn't change any of the above.
Reporting something
If you see something that breaks §4, report it — from the moment or comment itself, or under Settings → Report a problem. If it's urgent or involves a risk to someone's safety, email hello@megamindlabs.ai directly and say so in the subject line.
Reporting in good faith never counts against you. Filing reports you know to be false does.
Your content stays yours
You keep every right you already have in the photos and words you post. We claim no ownership of them.
You give us a licence to do the things the app has to do with them: store them, back them up, resize and display them, and show them to the people you tagged in a moment. The licence is non-exclusive, worldwide, royalty-free, and lasts only as long as you keep the content in the app. It exists to run Marianito for you and for nothing else.
Specifically, we do not sell your content, use it in advertising, show it to people you didn't tag, or use it to train machine-learning models.
If you post content, you're confirming you have the right to — including the agreement of recognisable people in your photographs.
Copyright complaints: email hello@megamindlabs.ai with a link to or description of the content, proof you hold the right, and your contact details. We remove infringing content and repeatedly-infringing accounts.
Our content
The app itself — its name, design, artwork, and code — belongs to us. You get a personal, non-transferable, revocable right to use the app as intended. You may not copy, modify, decompile, or redistribute it, except where the law says you may regardless.
Privacy and location
What we collect and why is in the Privacy Policy, which forms part of these terms.
Two points that belong here as well:
Location is off unless you turn it on. With it on, the app reads your position only while it is open on screen, to work out which friends are near you. Your coordinates are never shown or sent to other users — the comparison happens on our server and others learn only "nearby". Turn it off in Settings and the stored position is deleted.
Other people's data. When you tag someone or add a guest, you're putting information about a real person into the app. Do that only for people who would be fine with it.
Leaving, and account deletion
You can delete your account at any time under Settings → Delete my account. It is immediate and permanent. It removes your profile, photos, journal, stored location, friendships, settings, and the guests you created. Moments you started are removed for everyone who was at those tables; moments where you were only tagged remain for the others, without you.
We may suspend or close your account for a breach of §4, or if we stop running Marianito. If we stop running it, we will give reasonable notice and time to retrieve what you've posted, unless we're prevented from doing so.
Sections 4, 7, 11, 12, 13 and 14 survive the end of your account.
The service, as it is
Marianito is provided "as is". We don't promise it will be uninterrupted, error-free, or that content will never be lost — it is beta software, and §3 means it.
We don't check that what other users post is true, lawful, or safe, beyond the filtering and reporting described in §5. Content posted by other users is theirs, not ours, and interacting with other people through the app is at your own risk.
To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — including, if you're a consumer in the EU or UK, your statutory rights, which these terms do not affect.
Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss, loss of data, loss of profit, or loss of goodwill; and our total liability to you for any claim is limited to the greater of what you have paid us (currently nothing — Marianito is free) or US$100.
Governing law
These terms are governed by the law of the State of Wyoming, USA, without regard to its conflict-of-law rules, and the state and federal courts sitting in Sheridan County, Wyoming have jurisdiction.
If you're a consumer, that does not take away the protection of mandatory consumer law where you live, or your right to bring proceedings in your own country. Marianito is used in Spain and elsewhere in the EU, and choosing Wyoming law here does not displace consumer protections you have there.
Apple
You agree that:
These terms are between you and us, not Apple. Apple is not responsible for Marianito or its content.
Apple has no obligation to provide support or maintenance for Marianito.
If the app fails to conform to any applicable warranty, you may tell Apple and Apple may refund the purchase price (there isn't one — Marianito is free). Beyond that, Apple has no warranty obligation.
Apple is not responsible for claims about the app, including product liability, failure to meet a legal requirement, or consumer-protection claims.
Apple is not responsible for third-party intellectual-property claims about the app.
Apple and its subsidiaries are third-party beneficiaries of these terms, and may enforce them against you.
You confirm you are not in a country subject to a US Government embargo, and are not on a US Government prohibited-parties list.
Changes to these terms
We may update these terms. If a change is significant we'll tell you in the app before it takes effect, and update the date at the top. Carrying on using Marianito after that means you accept the new version; if you don't, delete your account under §10.
Odds and ends
If a part of these terms turns out to be unenforceable, the rest still stands. Not enforcing something once doesn't mean we've given it up. You may not transfer your rights under these terms; we may transfer ours to a company that takes over Marianito, on the same terms.
